The Constitutional Court of the Republic of Belarus considered the issue of initiating proceedings on a case based on a citizen's constitutional complaint

On 31 October 2024 the Constitutional Court of the Republic of Belarus considered the issue of initiating proceedings on a case on the constitutionality of paragraph two of part two of Article 319 of the Economic Procedure Code of the Republic of Belarus based on a constitutional complaint by citizen V.A. Andrievsky.

V.A. Andrievsky, who is an individual entrepreneur, filed a complaint with the Constitutional Court to review the constitutionality of paragraph two of part two of Article 319 of the Economic Procedure Code of the Republic of Belarus, applied by the Economic Court of the Mogilev Region when considering his application to reopen the case based on newly discovered circumstances.

As a result of consideration, the Constitutional Court refused to initiate proceedings on the case on the constitutionality of the said provision of the Economic Procedure Code of the Republic of Belarus, since there are no signs of a violation of the constitutional rights of the applicant, and the complaint does not meet the admissibility condition defined by subparagraph 1.1 of paragraph 1 of Article 153 of the Law of the Republic of Belarus “On the Constitutional Proceedings”.
