On 4 April 2024 the International Conference “The Supremacy of the Constitution: Constitutional Changes and Modern Development of Constitutional Review”, dedicated to the 30th anniversary of the Constitutional Court of the Republic of Belarus, was held in Minsk

The Conference was attended by delegations of the constitutional courts of Azerbaijan, Armenia, Kazakhstan, Kyrgyzstan, Russia, Uzbekistan, as well as judges of the Constitutional Court of the Republic of Belarus, representatives of government bodies of the Republic of Belarus, prominent constitutional scholars.

The President of the Republic of Belarus A.G. Lukashenko sent greetings to the participants of the Conference.

The discussions focused on ensuring the supremacy of the Constitution, constitutionalisation of legislation and law enforcement practice, modern constitutional reforms and the role of constitutional courts in ensuring constitutional order.

Chairman of the Constitutional Court Petr Miklashevich, addressing the participants of the Conference with his opening remarks, noted the following.

The Constitution of the Republic of Belarus, adopted on 15 March 1994, defines the main goal of state and constitutional development - to build a sovereign democratic social state based on the rule of law.

For this purpose, the following institutions were established at the constitutional level:

firstly, the institution of the presidency, which ensures the efficiency and interaction of government bodies and the unity of the people;

secondly, the institution of constitutional review, which ensures the supremacy of the Constitution and compliance with the principles of the rule of law.

Today we can say with confidence:

1) a sovereign democratic social state for the people has been built in Belarus, expressing the will of the people and functioning in the interests of the people. The presidential form of government has shown its effectiveness in solving the problems facing society and the state in modern conditions. It should be especially noted that the strong President – Alexander Lukashenko – has made and is making a huge contribution to ensuring independence and sovereignty, sustainable and dynamic socio-economic development of the country;

2) in Belarus, a legal system has been formed and operates on the principles of the rule of law, guarantees of human and civil rights and freedoms are actually ensured, and the constitutional order is being established.

Established in April 1994, the Constitutional Court, through reviewing the constitutionality of normative legal acts, contributes to ensuring the supremacy of the Constitution, protecting the constitutional order, the rights and freedoms of citizens, and maintaining the proper regime of constitutional legality.

In its activities, the Constitutional Court uses various forms of constitutional review: subsequent and preliminary, abstract and concrete, optional and mandatory. During the Conference, we will exchange experience in administering constitutional justice, taking into account the characteristics of national legal systems.
