On the procedure for the entry into force of the Law of the Republic of Belarus “On the Constitutional Proceedings”

On 17 July 2023 the President of the Republic of Belarus signed the Law of the Republic of Belarus “On Making Amendments to Laws on Constitutional Proceedings”. According to Article 1 of the mentioned Law, the Law of the Republic of Belarus “On the Constitutional Proceedings” is set out in a new edition, which determines the legislative mechanism for the exercise of the new powers of the Constitutional Court enshrined in the updated Constitution of the Republic of Belarus.

The Law of the Republic of Belarus of 17 July 2023 No. 284-Z “On Making Amendments to Laws on Constitutional Proceedings” was officially published on 21 July 2023.

In accordance with Article 13 of this Law, it shall come into force in the following order:

Article 1 in the part that refers to the procedure established by the Law of the Republic of Belarus “On the Constitutional Proceedings” (as amended by the Law of the Republic of Belarus of 17 July 2023) relating the facts of consistent or gross violation of the Constitution by the President, the constitutionality of the elections of the President, deputies of the House of Representatives and members of the Council of the Republic, as well as the powers of the Presidium of the All-Belarusian People’s Assembly – from the date of formation of the Presidium of the All-Belarusian People's Assembly;

other provisions of Article 1, Articles 2–10, part one of Article 11 – from 1 October 2023;

other provisions – after its official publication.

Thus, the Law of the Republic of Belarus “On the Constitutional Proceedings” (as amended by the Law of the Republic of Belarus of 17 July 2023) will enter into force on 1 October 2023, except for certain provisions, that will come into force from the date of formation of the Presidium of the All-Belarusian People's Assembly.
