On 27–29 December 2021 the Constitutional Court of the Republic of Belarus considered the constitutionality of certain laws of the Republic of Belarus in the exercise of the obligatory preliminary review

On 27–29 December 2021, by virtue of Article 116.1 of the Constitution of the Republic of Belarus, Article 22.3.2 of the Code of the Republic of Belarus on Judicial System and Status of Judges, Articles 98 and 101.1 of the Law of the Republic of Belarus “On Constitutional Proceedings”, the Constitutional Court of the Republic of Belarus considered the constitutionality of the following laws of the Republic of Belarus, adopted by the House of Representatives and approved by the Council of the Republic of the National Assembly of the Republic of Belarus, in the exercise of obligatory preliminary review:

“On the Republican Budget for 2022” (reporting judge – Tatyana Boiko);

“On Making Amendments to Laws on Taxation” (reporting judge – Tatyana Boiko);

“On the Budget of the State Extra-Budgetary Fund of Social Protection of the Population of the Republic of Belarus for 2022” (reporting judge – Viktor Ryabtsev);

“On the Genocide of the Belarusian People” (reporting judge – Stanislav Danilyuk);

“On Making Amendments to the Law of the Republic of Belarus “On Investment” (reporting judge – Tatyana Boiko);

“On Making Amendments to the Law of the Republic of Belarus “On Notaries and Notarial Activities” (reporting judge – Tadeush Voronovich);

“On Making Amendments to Laws on Ensuring the Uniformity of Measurements and Protection of Waters” (reporting judge – Tadeush Voronovich);

“On Making Amendments to Certain Codes” (reporting judge – Tadeush Voronovich);

“On Making Amendments to the Law of the Republic of Belarus “On State Awards of the Republic of Belarus” (reporting judge – Leonid Ryabtsev);

“On Making Amendments to Laws on the Prevention of Offences” (reporting judge – Leonid Ryabtsev);

“On Making Amendments to the Law of the Republic of Belarus “On Free Economic Zones” (reporting judge – Liliya Kozyreva);

“On Making Amendments to the Law of the Republic of Belarus “On State Innovation Policy and Innovation Activity in the Republic of Belarus” (reporting judge – Alla Bodak);

“On Making Amendments to Laws on Environmental Protection and Environmental Management” (reporting judge – Anatoly Tikovenko).

Based on the results of consideration the said laws were recognised to be conforming to the Constitution of the Republic of Belarus. At the same time the Constitutional Court stated its legal positions aimed to clarify the constitutional and legal meaning of certain provisions of the reviewed laws.
