On 30 April 2021, by virtue of Article 116.1 of the Constitution of the Republic of Belarus, Article 22.3.2 of the Code of the Republic of Belarus on Judicial System and Status of Judges, Articles 98 and 101.1 of the Law of the Republic of Belarus “On Constitutional Proceedings”, the Constitutional Court of the Republic of Belarus considered the constitutionality of the following laws of the Republic of Belarus, adopted by the House of Representatives and approved by the Council of the Republic of the National Assembly of the Republic of Belarus, in the exercise of obligatory preliminary review:
“On the Prevention of the Rehabilitation of Nazism” (reporting judge – Tadeush Voronovich);
“On Making Amendments to Laws on Countering Extremism” (reporting judge – Stanislav Danilyuk);
“On Making Amendments to the Law of the Republic of Belarus “On Mass Events in the Republic of Belarus” (reporting judge – Tadeush Voronovich);
“On Making Amendments to Laws on Ensuring the National Security of the Republic of Belarus” (reporting judge – Sergei Chigrinov);
“On Making Amendments to the Law of the Republic of Belarus “On State Protection of Judges, Law Enforcement and Supervisory (Monitoring) Officials, Employees of the State Guard Service” (reporting judge – Stanislav Danilyuk);
“On Making Amendments to Laws on Labour Relations” (reporting judge – Olga Sergeeva);
“On Making Amendments to Laws on Mass Media” (reporting judge – Liliya Kozyreva);
“On Making Amendments to the Law of the Republic of Belarus “On Telecommunications” (reporting judge – Anatoly Tikovenko).
Based on the results of consideration the said laws were recognised to be conforming to the Constitution of the Republic of Belarus. At the same time the Constitutional Court stated its legal positions aimed to clarify the constitutional and legal meaning of certain provisions of the reviewed laws.
