On the 17 of February 2009 a meeting took place of Chairman of the Constitutional Court of the Republic of Belarus Petr P. Miklashevich with the Parliamentary Assembly Council of Europe delegation led by Chairman of the Political Affairs Committee of PACE Göran Lindblad.
Participants of delegation were informed about the activity of the Constitution Court of the Republic of Belarus, its structure, competence, the procedure of formation, new powers based on the obligatory preliminary constitutional control of the laws adopted by the Parliament before the President of the Republic of Belarus sign.
Petr P. Miklashevich also informed about the adopted by the Constitutional Court of the Republic of Belarus on the February 4, 2009 Message to the President of the Republic of Belarus and Chambers of Parliament on the constitutional legality in the Republic of Belarus, 2008 in which was underlined the necessity of the strict observance of the supremacy of law during formation of the state ruled by law, securing of the constitutionality of legal regulation of the social relations, establishment of the uniform enforcement practice of the legal norms by all state bodies including courts, control and supervising bodies.
It was explained the position on the legal basis of the possibilities of abolition of the death penalty in Belarus and declaration of the moratorium on execution of this kind of punishment. Attention was paid to this fact that the Constitutional Court on the March 11, 2004 has delivered the Judgment on this issue in which has found the unconstitutional norms of the Criminal Code of the Republic of Belarus in relation to absence in them of the specification of the temporary character of the death penalty.
Concerning the issues connected with securing of principle of independence the judicial power it was underlined that in the Basic Law of our country is enshrined the principle of the separation of powers, at the legislative level the procedures of the judges appointment, the legal and social guarantees which secure the necessary conditions for the independent realization of justice are established.
As the conclusion of the meeting Petr P. Miklashevich expressed the hope that the Parliament of our country can hold in the near future the Special Guest status in PACE that will promote more effective implementation the European democratic principles and standards to the national legislation.
