On 24 and 26 December 2020 the Constitutional Court of the Republic of Belarus considered the constitutionality of certain laws of the Republic of Belarus in the exercise of the obligatory preliminary review

On 24 and 26 December 2020, by virtue of Article 116.1 of the Constitution of the Republic of Belarus, Article 22.3.2 of the Code of the Republic of Belarus on Judicial System and Status of Judges, Articles 98 and 101.1 of the Law of the Republic of Belarus “On Constitutional Proceedings”, the Constitutional Court of the Republic of Belarus considered the constitutionality of the following laws of the Republic of Belarus, adopted by the House of Representatives and approved by the Council of the Republic of the National Assembly of the Republic of Belarus, in the exercise of obligatory preliminary review:

“On Making Amendments to the Tax Code of the Republic of Belarus” (reporting judge – Tatyana Boiko);

“On the Republican Budget for 2021” (reporting judge – Tatyana Boiko);

“On the Budget of the State Extra-Budgetary Fund of Social Protection of the Population of the Republic of Belarus for 2021” (reporting judge – Viktor Ryabtsev);

 “On Making Amendments to the Law of the Republic of Belarus “On Joint Homeownership” (reporting judge – Olga Sergeeva;

“On Making Amendments to Laws on Scientific, Technical and Innovative Activities” (reporting judge – Alla Bodak;

“On Making Amendments to Laws on Economic Entities” (reporting judge – Liliya Kozyreva);

“On Making Amendments to the Law of the Republic of Belarus “On State Regulation of Trade and Public Catering in the Republic of Belarus” ( reporting judge – Liliya Kozyreva);

and other laws.

Based on the results of consideration the said laws were recognised to be conforming to the Constitution of the Republic of Belarus. At the same time the Constitutional Court stated its legal positions aimed to clarify the constitutional and legal meaning of certain provisions of the reviewed laws.
