On 9-11 December 2019 the Constitutional Court of the Republic of Belarus, in the exercise of the obligatory preliminary review, considered the constitutionality of certain laws of the Republic of Belarus

On 9-11 December 2019, by virtue of Article 116.1 of the Constitution of the Republic of Belarus, Article 22.3.2 of the Code of the Republic of Belarus on Judicial System and Status of Judges, Article 98 and Article 101.1 of the Law of the Republic of Belarus «On the Constitutional Proceedings», the Constitutional Court of the Republic of Belarus, in the exercise of the obligatory preliminary review, considered the constitutionality of the following laws of the Republic of Belarus, adopted by the House of Representatives and approved by the Council of the Republic of the National Assembly of the Republic of Belarus:

“On the Republican Budget for 2020” (reporting judge – Tatyana Boiko);

“On the Budget of the State Extra-Budgetary Fund of Social Protection of the Population of the Republic of Belarus for 2020” (reporting judge – Viktor Ryabtsev);

“On Making Amendments to the Law of the Republic of Belarus “On Local Government and Self-Government in the Republic of Belarus” (reporting judge – Natallia Karpovich);

“On Making Amendments to the Law of the Republic of Belarus “On Protection of the Rights of Consumers of Housing and Communal Services” (reporting judge – Alla Bodak);

“On Making Amendments to the Law of the Republic of Belarus “On Labour Protection” (reporting judge – Alla Bodak);

“On Forensic Expert Activities” (reporting judge – Tadeush Voronovich);

“On Protection and Use of Peatlands” (reporting judge – Viktor Ryabtsev);

“On Making Amendments to the Law of the Republic of Belarus “On Telecommunications” (reporting judge – Anatoly Tikovenko);

“On Making Amendments to the Law of the Republic of Belarus “On Facilities that are in the Ownership of the State only, and Certain Types of Activity with the Exclusive Right of the State to Conduct them” (reporting judge – Olga Sergeeva);

“On Making Amendments to the Law of the Republic of Belarus “On Legal Status of Foreign Citizens and Stateless Persons in the Republic of Belarus” (reporting judge – Sergei Chigrinov);

and other laws.

Based on the results of consideration the said laws were recognised to be conforming to the Constitution of the Republic of Belarus. At the same time the Constitutional Court stated its legal positions aimed to clarify the constitutional and legal meaning of certain provisions of the reviewed laws.
