During judicial sittings on the December 8 and 27, 2008 the Constitutional Court of the Republic of Belarus in accordance with the procedure of the obligatory preliminary control has considered 10 laws of the Republic of Belarus (such as “On the atmosphere protection”, “On the social protection of the citizens who have suffered on the Chernobyl Atomic power Station accident and other radiating failures”, “On the commodity exchanges”, “On making alterations and addenda into some laws of the Republic of Belarus concerning the state social insurance and employment of the population” and other) and has delivered decisions on its conformity to the Constitution of the Republic of Belarus.
At examination of constitutionality of the Law of the Republic of Belarus “On the social protection of the citizens who have suffered on the Chernobyl atomic power station accident and other radiating failures” the Constitutional Court has noted that estimating the expediency and economic validity of the examined Law does not enter into a subject of its examination, according to sense of the Code of the Republic of Belarus on Judicial system and Status of judges and the Decree of the President of the Republic of Belarus June 26, 2008 No. 14.
At examination of constitutionality of the Law of the Republic of Belarus “On making alterations and addenda in some laws of the Republic of Belarus concerning the State and mobilization material reserves” the Constitutional Court according to the sense of the legal norm containing in the part fourth of Article 104 of the Constitution of the Republic of Belarus noted that the program laws need a special procedure of making an alterations and addenda into them. Such special procedure is embodied of making an alterations and addenda by additional law which should be adopted not less than of two thirds of voices of deputies and members of Chambers of Parliament.
