On 17th September, 2008 the Chairman of the Constitutional Court of the Republic of Belarus Petr Miklashevich has met the Head of Mission of the OSCE’s Office for Democratic Institutions and Human Rights (OCSE/ODIHR) on the observation of the Parliamentary elections in Belarus Ambassador Geert-Hinrich Ahrens.
Petr Miklashevich noted that the Constitutional Court of the Republic of Belarus is the state body that shall secure the constitutional legality in Belarus and it is concerned in holding of the Parliamentary elections in Belarus openly, democratically and in strict conformity with provisions of the Constitution and the Electoral Code along with unconditional observance of the legislation by all participants of the electoral process.
Thus he noticed that although the Constitutional Court does not control the electoral process directly in case of applying of the authorised subjects to the Court it will consider the issues concerning constitutionality of provisions of the electoral legislation within the limits of its competence. So far, there have been no applications in the Constitutional Court connected with this election campaign.
The Chairman of the Constitutional Court Petr Miklashevich also informed Mr Ahrens about the structure, the competence of the Constitutional Court, practice of consideration of the issues initiated by subjects empowered to appeal to the Constitutional Court.
