P.P.Miklashevich. Improvement and future development of the constitutional control in the Republic of Belarus

The article deals with the directions for improvement and future development of the constitutional control, results of the 15 years of activities to exercise the powers of the Constitutional Court as well as the prospects for the development of the constitutional justice in the Republic of Belarus. The conclusions are made on the need for the new normative legal act on constitutional proceedings; working out of the procedural and organisational legal mechanisms to enforce the right to appeal before the Constitutional Court in an indirect way; elaboration of the execution methodology for the obligatory preliminary constitutional control of laws; reasoning of the theoretical and practical aspects, related to the constitutional principles comprehension.

A.G.Tikovenko. Constitutionality problems of normative legal acts and state bodies activities

This article analyses the notion “constitutionality” being applied in theory, laws and constitutional control practice. Special attention is given to the constitutionality criteria for normative legal acts in the legislation of the Republic of Belarus. A thorough analysis is carried out on the principle of legal definiteness as the constitutionality criterion of the normative legal provisions.

V.V.Podgrusha. Constitutional proceedings: the study of the notion content and its legal providing

This article sets out the basic approaches to the definition of the notion “constitutional proceedings” and to its legal stipulation. In view of the analysis of normative provisions relating to judicial proceedings generally and to its particular forms the author comes up with consideration of constitutional proceedings as the regulated by law norms operating procedures of the Constitutional Court to adjudicate the cases and matters within its competence which are subject-matters thereof. The constitutional proceedings and constitutional justice are bound from each other. The author argues that constitutional proceedings should be logically and reasonably provided in a code.

L.A.Kiseleva. Legal status of a research worker in labour legislation of the Republic of Belarus: the general and the particular

This article analyses the character of scientific activities and labour legislation of the Republic of Belarus which regulates legal status of a research worker. Close attention is focused on the employment, staff rating, particulars of the rights and responsibilities of research workers. The effective legislation analysis resulted in the proposals to enhance the scientific work prestige and to improve the legal status of a research worker in view of its job factors.

T.V.Rogozhkina. Licensing as an element to enforce the constitutional norms stipulating the relationship grounds in labour protection

The present article is about the research on establishing the norms of ecological legislation which regulates the administrative procedure (licensing) for use of natural resources and environmental protection according to the provisions of the Constitution of the Republic of Belarus. Licensing in the field of environmental protection is considered to be one of the elements to provide constitutional norms enforcement aiming at the regulation of relations in the ecological sphere. There are marked out some steps to the legal regulation development in the environmental licensing. The author points at non-specific approaches to the licensing of natural resources use and environmental protection and gives reasons for their necessary establishments in ecological legislation for the fullest enforcement of the constitutional norms.
