In the exercise of obligatory preliminary review the Constitutional Court of the Republic of Belarus considered the constitutionality of the laws of the Republic of Belarus “On Making Alterations and Addenda to the Law of the Republic of Belarus “On Counteracting Monopolistic Activities and Promoting Competition”, “On Making Addenda and Alterations to the Law of the Republic of Belarus “On Combating Terrorism”, “On Making Addenda and Alterations to the Law of the Republic of Belarus “On Pension Provision”, “On Making Addenda and Alterations to the Criminal Procedure Code of the Republic of Belarus”, “On Making Alterations and Addenda to the Civil Procedure Code of the Republic of Belarus” and others
On 28 December 2017 by virtue of Article 116.1 of the Constitution of the Republic of Belarus, Article 22.3.2 of the Code of the Republic of Belarus on Judicial System and Status of Judges, Article 98 and Article 101.1 of the Law of the Republic of Belarus «On the Constitutional Proceedings» in the exercise of obligatory preliminary review the Constitutional Court of the Republic of Belarus considered the constitutionality of the following laws of the Republic of Belarus adopted by the House of Representatives and approved by the Council of the Republic of the National Assembly of the Republic of Belarus:
“On Making Alterations and Addenda to the Law of the Republic of Belarus “On Counteracting Monopolistic Activities and Promoting Competition” (reporting judge – Tatyana Boiko);
“On Making Addenda and Alterations to the Law of the Republic of Belarus “On Combating Terrorism” (reporting judge – Stanislav Danilyuk);
“On Making Addenda and Alterations to the Law of the Republic of Belarus “On Pension Provision” (reporting judge – Valentina Podgrusha);
“On Making Addenda and Alterations to the Criminal Procedure Code of the Republic of Belarus” (reporting judge – Tadeush Voronovich);
“On Making Alterations and Addenda to the Civil Procedure Code of the Republic of Belarus” (reporting judge – Tadeush Voronovich);
“On Making Alterations and Addenda to the Code of the Republic of Belarus on Administrative Offences and to the Procedural Executive Code of the Republic of Belarus on Administrative Offences» (reporting judge – Stanislav Danilyuk);
“On Making Alterations and Addenda to Certain Laws of the Republic of Belarus on State Registration of Real Estate, Real Estate Rights and Related Transactions” (reporting judge ‒ Liliya Kozyreva);
“On Making Addenda and Alterations to the Law of the Republic of Belarus “On Names of Geographical Objects” (reporting judge – Sergei Chigrinov);
“On Making Alterations and Addenda to Certain Laws of the Republic of Belarus” (reporting judge ‒ Liliya Kozyreva);
“On Making Addenda and Alterations to the Law of the Republic of Belarus “On Physical Culture and Sports” (reporting judge ‒ Viktor Ryabtsev).
Based on the results of consideration the said laws were recognised to be conforming to the Constitution of the Republic of Belarus. At the same time the Constitutional Court stated its legal positions aimed to clarify the constitutional and legal meaning of certain provisions of the reviewed laws.
