Voronovich T.V. Constitutional and Legal Aspects of the Guarantee of Judicial Protection of the Human Rights and Freedoms
The article deals with the right to judicial protection as a constitutional and (or) a subjective right of everyone to seek protection of his/her subjective rights and legitimate interests by resorting to the competent authority of the state – the court. The author reveals the elements that define the content of this right. By analyzing the practice of the constitutional courts of Belarus and Russia as well as the European Court of Human Rights the author grounds the opinion that this right is both a subjective right and a constitutional guarantee of the protection of the human rights and freedoms.
Kozyreva L.G. The Role of Legal Positions of the Constitutional Court in the Regulation of Economic Relations
The article deals with the analysis of the provisions of the Constitution of the Republic of Belarus which are the legal basis for the development of economic relations in the Republic of Belarus. The author gives the legal positions of the Constitutional Court that reveal the meaning and the content of the constitutional provisions with regard to public relations in the economic field regulated by legislative acts.
