Karpovich N.A. Interpretation of the Activity of the Constitutional Court in a Democratic Society: the Experience of the Republic of Belarus
The article deals with the analysis of the bases and limits of the interpretative activity of the constitutional courts in modern democracies. The author covers the experience of the Constitutional Court of the Republic of Belarus on the interpretation of the constitutional principles and norms. The author concludes that the interpretative activity of these bodies contributes to the fullest implementation of the interpreted constitutional provision in public and social policy and practice, prevention of violations of the constitutional legality, development of the constitutional and legal regulation and its effectiveness, overcoming gaps and collisions having the constitutional and legal significance in the legislation.
Ryabtsev L.M., Egorov D.A. Constitutional and Legal Aspects of the Administrative and Legal Regimes in the Republic of Belarus
The article is devoted to the study of the constitutional and legal aspects of the relevant regimes of administrative and legal regulation of social relations in the sphere of public administration. Particular attention is drawn to the constitutional principles and norms that enshrine the purposes of introduction and the field of functioning of the administrative and legal regimes, bases of the organisation and activities of the subjects of these regimes, their place in the state mechanism, the human rights and freedoms, that are realis within these regimes, legal mechanisms for their protection, foundation, order, limits of the restriction and suspension of the human rights and freedoms under the conditions of the mentioned regimes.
Silchenko N.V. Law-Making and Law-Making Process in the System of Concepts of the General Theory of the Information Law
The concepts of law-making and law-making process are studied through their systemic connection with the concept of law, its forms, sources and norms taking into account the ways of law formation. On this basis the author gives the definitions of law-making and law-making process and shows their types and kinds. At the same time these concepts are considered as identical in terms of volume, but aimed at identifying different aspects of the activity resulting in creation, amendment or abrogation of legal rules.
