Miklashevich P.P. The Role of the Constitutional Review in the Development of Constitutionalism
The article deals with modern conditions of formation of constitutionalism, focuses on the development of constitutionalism in the Republic of Belarus, draws attention to the role of the constitutional review in this process. The author makes a conclusion on the necessity to rethink the role of the integration law in the national legislative system, as well as to harmonise approaches to the constitutional identity in the activities of the constitutional review bodies of the member states of the Common Eurasian Economic Space.

The article deals with the role of legal positions of the Constitutional Court as elements of the legal system of the Republic of Belarus. It is grounded that legal positions in this system carry out a number of important functions, but they can not be attributed to any of the traditional forms of existence of law. The author underlines the necessity to improve regulation of the place of legal positions of the Constitutional Court in the legal system by means of legislative acts on the constitutional proceedings.
