On 27 December 2016 in the exercise of obligatory preliminary review the Constitutional Court of the Republic of Belarus considered the constitutionality of the laws of the Republic of Belarus «On Making Alterations and Addenda to Certain Laws of the Republic of Belarus on Declaring of Income and Property», «On Making Addenda and Alterations to the Law of the Republic of Belarus «On the Bases of Administrative Procedures», etc.
By virtue of Article 116.1 of the Constitution of the Republic of Belarus, Article 22.3.2 of the Code of the Republic of Belarus on Judicial System and Status of Judges, Article 98 and Article 101.1 of the Law of the Republic of Belarus «On the Constitutional Proceedings» in the exercise of obligatory preliminary review the Constitutional Court of the Republic of Belarus considered the constitutionality of the following laws of the Republic of Belarus adopted by the House of Representatives and approved by the Council of the Republic of the National Assembly of the Republic of Belarus:
«On Making Alterations and Addenda to Certain Laws of the Republic of Belarus on Declaring of Income and Property» (reporting judge – Olga Sergeeva);
«On Making Addenda and Alterations to the Law of the Republic of Belarus «On the Bases of Administrative Procedures» (reporting judge – Olga Sergeeva);
«On Making Alterations and Addenda to Certain Laws of the Republic of Belarus» (reporting judge – Valentina Podgrusha);
«On Making Addenda and Alterations to Certain Laws of the Republic of Belarus» (reporting judge – Natalya Karpovich);
«On Making Addenda and Alterations to Certain Laws of the Republic of Belarus» (reporting judge – Liliya Kozyreva).
Based on the results of consideration the said laws were recognised to be conforming to the Constitution of the Republic of Belarus. At the same time the Constitutional Court stated its legal positions aimed to clarify the constitutional and legal meaning of certain provisions of the reviewed laws.
