Sergeeva O.G. Constitutional Proceedings in the Republic of Belarus

On the basis of analysis of provisions of the Law of the Republic of Belarus of January 8, 2014 «On the Constitutional Proceedings» the author considers in detail the issues of the exercise of the constitutional justice which previously were regulated by the Law of the Republic of Belarus «On the Constitutional Court of the Republic of Belarus» (1994), the Code of the Republic of Belarus on Judicial System and Status of Judges and the Rules of the Constitutional Court of the Republic of Belarus. The article draws attention to the systemic nature of regulation of the constitutional proceedings that will contribute to improve the organisation and procedure of the activities of the Constitutional Court in the exercise of its powers and, as a consequence, increase the role of the Constitutional Court in the State and society.

The article deals with the notion of constitutionality in the theory, laws and practice of the constitutional review. Particular attention is paid to the criteria of the constitutionality of normative legal acts which are used in the practice of the Constitutional Court of the Republic of Belarus. The principle of legal certainty as a criterion of the constitutionality of legal rules of normative acts is analysed in detail.
