Miklashevich P.P. The Constitution of the Republic of Belarus: Strategy of Democratic Development

 

In the article devoted to the 20th anniversary of the Constitution of the Republic of Belarus the author draws attention to important constitutional and legal aspects ‒ supremacy of the Constitution as a determining condition for the stability of the constitutional system and its importance as a fundamental factor for sustainable and progressive development of the society and the state. Conclusions are made about the need of the constitutionalization of social relations, systemic use of the regulatory potential of the Constitution and further development of constitutional doctrine, formation of the constitutional patriotism in the society.

 

Podgrusha V.V. Dissenting Opinion of a Judge of the Constitutional Court

 

The article deals with the issue of expression of a dissenting opinion by judges of the bodies of the constitutional justice. It is analyzed the legal regulation of this issue in the legislation of some countries, first of all Belarus and Russia, and also the constitutional practice in this sphere.

The article deals with some constitutional and legal aspects of civilian weapons turnover in the Republic of Belarus, analyses normative legal acts regulating the turnover of civilian weapons on the territory of the Republic of Belarus. Taking into account legal positions of the Constitutional Court of the Republic of Belarus and the Constitutional Court of the Russian Federation the author makes appropriate conclusions on these issues and makes suggestions to improve the legislation regulating the turnover of civilian weapons.

 

Danilyuk S.Y. Constitutional Basis of Criminal Liability and Acceptable Restrictions of the Rights and Freedoms of Individuals

 

The article deals with features of the effect of provisions of the Constitution on the content of criminal legal rules. According to the author, the Constitution is not only formal legal source of current criminal law, but also has value-orienting importance for its further improvement.

Particular attention is drawn to analysis of the problem of restriction of the rights and freedoms of an individual which is very relevant problem for the law-making and law-enforcement.

 

Derbina G.V. Traditions of the Belarusian Constitutionalism

 

The article deals with problems of the formation of traditions of domestic constitutionalism in the period of the Great Duchy of Lithuania (XVI-XVIII centuries) and with the concept of codification of the law of the Great Duchy of Lithuania as part of Romano-Germanic legal family. The author considers the factors determining the formation of the concept of codification of the law of the Great Duchy of Lithuania as well as traditions of constitutionalism.
