Chairman of the Constitutional Court of the Republic of Belarus Petr P. Miklashevich took part in the Pan-European Conference “The European Legal Standards of the Rule of Law and the Scope of Discretion of Powers in the Member-States of the Council of Europe”

On 3–6 July 2013 Chairman of the Constitutional Court of the Republic of Belarus Petr P. Miklashevich took part in Pan-European Conference “The European Legal Standards of the Rule of Law and the Scope of Discretion of Powers in the Member-States of the Council of Europe” (Yerevan, Republic of Armenia).

Heads and judges of Constitutional Courts of foreign states, European Court of Human Rights, representatives of parliaments, ministries of justice and international relations as well as human rights ombudsmen from 32 countries took part in the forum. 

The issues of provision of the rule of law in a democratic state based on the rule of law, interaction between the constitutional review bodies and national parliaments, contemporary European tendencies of the scope of discretion detection in activities of parliaments and the role of the constitutional courts in this process were discussed during the conference. 

Chairman of the Constitutional Court Petr P. Miklashevich in his speech informed the participants on the constitutional legal aspects of the rule of law and the scope of discretion of the legislative power. It was also mentioned that the principle of the rule of law is stipulated on the constitutional level, the necessary measures are undertaken on the state level to its actual implementation in political, legal and socio-economic life of the society and state. The state authority while executing its powers operates within the limits defined by the provisions, principles and rules of the Constitution. The Constitutional Court by exercising the review of the constitutionality of normative legal acts in the state obligates the legislative power to strictly follow the principles of the rule of law and supremacy of the Constitution in legislative process, as well as to avoid any arbitrary discretion in legal regulation of social relations.
