Petr P. Miklashevich Constitutional values and modern trends of constitutionalism development

Annotation

The current trends in the development of constitutionalism are considered under the prism of the civilizational values and European democratic standards, as well as enshrined in the national constitutions. The role of the constitutional justice in Belarus in the constitutional values protection at the stage of the formation of the state ruled by law in our country is revealed. It is noted that the democratic social state ruled by law is the fundamental constitutional value in the Republic of Belarus. It serves as the initial foundation of effective implementation of other constitutional values, including the highest constitutional purpose and value – the individual.

Annotation

Under consideration there are the provisions of the Constitution of the Republic of Belarus relating the economic activity, the legal positions of the Constitutional Court of the Republic of Belarus in the interpretation of the rules and principles of the Constitution on the freedom of business activity, regulation of economic activity by the State in the interests of the individual and society. The issues of the constitutional right to judicial protection in business activities are considered in the article.

Annotation

The article deals with certain current issues of the crime control state policy, received a legal regulation in the acts of criminal, criminal procedure and penal enforcement legislation, the rules of which were the subject of the obligatory preliminary review of the Constitutional Court.

The author refers to certain decisions of the Constitutional Court, which contain the legal positions aimed to reveal the constitutional legal meaning of the rules of the laws in consideration including the addressed ones to the subjects of law-making and law enforcement in order to overcome the deficiencies of legal regulation and unconstitutional law enforcement practice prevention.
