The Chairman of the Constitutional Court of the Republic of Belarus Petr P. Miklashevich took part in the International Conference on The Protection of Human Rights by bodies of constitutional justice: possibilities and problems of individuals access”, which took place in Kiev (Ukraine) on the 16th of September, 2011.
Heads and judges of constitutional courts and equivalent bodies from 18 countries, the President of the Venice Commission of the Council of Europe Gianni Buquicchio, the Director of the German Foundation for International Legal Co-operation Dirk Mirow, representatives of other international organisations, and constitutional law scientists attended the Conference.
Issues on the access to the Constitutional Court were discussed on the plenary session together with national experience and prospects of introducing the constitutional complaint institute in different countries. Participants of the forum noticed that the right of citizens to appeal to the constitutional control bodies is an important factor in the mechanism of guaranteeing human rights and freedoms.
In his statement, the Chairman of the Constitutional Court of the Republic of Belarus Petr P. Miklashevich informed the participants of the forum about the system of indirect access of individuals to constitutional justice in the Republic of Belarus and the prospects of its development. Meanwhile it was pointed out that the realisation of the obligatory constitutional review of the constitutionality of all laws by the Constitutional Court promotes for the viewpoint of Belarusian citizens of the constitutionality of laws and abates the necessity to introduce the constitutional complaint institute.
The prospects of bilateral and multilateral co-operation were discussed during the work meetings with the heads of constitutional courts together with the intensification of the exchange of experience among constitutional control bodies from different countries.
