Miklashevich P.P. Constitutional Court of the Republic of Belarus: Functions and Cooperation with other State Authority Bodies

The article considers the issues dealing with the role and place of the Constitutional Court of the Republic of Belarus in the system of the bodies of state power, its constitutional legal status and main functions are analyzed. 
The conclusion is made that the practice of the execution of the decisions of the Constitutional Court justifies the effectiveness of the realization by the Constitutional Court of its functions. 
At the same time for the purposes of promotion of the effectiveness of execution of the functions of the constitutional control and achievement of the high level of interaction with other bodies of state power, further improvement of the constitutional legal proceedings and securing of the procedural independence of the Constitutional Court it is necessary to make respective addenda into the Code on Judicial System and Status of Judges, aimed at adjusting of the competence of the Constitutional Court and to adopt the Law «On the constitutional legal proceedings».

Podgrusha V.V. Social Justice Within Issues of Citizens’ Rights and Legal Interests Protection

The problem of the social justice principle implementation is considered in the Article based on constitutional provisions relating to social character of the Belarusian State, including at different stages of the Belarusian statehood formation and development. It is emphasised that realisation of social justice is impossible without effective social rights protection. Moreover, the legal and constitutional obligation of the State to guarantee and protect social rights should use the social justice principle as a basis so that it allows the social state to correct actual inequality. The place and the relevance of all the state power branches in solving problems of social inequality, as well as attitudes elaborated by the Constitutional Court in the course of particular cases examination are analysed in the Article.

Danilyuk S.Y. The Right to Life and Legal and Constitutional Aspects of the Death Penalty

Various aspects of the right to life, including issues of the death penalty from the standpoint of legal and constitutional values, of requirements of international documents relating to human rights and religious views are considered in the Article. Peculiarities of the legal grounds for the death penalty refusal in Russia and Ukraine are set forth. The author analyses some defects of legal regulation of the life imprisonment in the penal legislation of the Republic of Belarus. The problem of the public opinion influence on the settlement of the death penalty issue is touched upon.
