Miklashevich P.P. Improvement of legal basis of the constitutional proceedings in the Republic of Belarus
The author argues in favour of that further improvement of the legal basis of constitutional proceedings in the Republic of Belarus at the legislative level should occur in a view of the separation of substantive and procedural rules governing the activities of the Constitutional Court. The principles and characteristics of proceedings in preliminary and subsequent constitutional review and other court powers are under detailed consideration. The grounds are given for an appropriate stipulation of supplementary powers, which have passed practical evaluation and showed their efficiency, in the Code of Judicial System and Status of Judges. It is stated that the rules of constitutional proceedings should avoid excessive details and strict regulation based on the special nature of judicial review. The article provides for a number of other conclusions, aimed at improving the legal basis of constitutional proceedings.
Voronovich T.V. On the issue of revision of prior decisions by constitutional review bodies
The article contains an analysis of laws of different countries on bodies of constitutional review. Relevant provisions of the preliminary study of the Secretariat of the Venice Commission on the issue of the individual access to constitutional justice are also analysed as regards the admissibility of revision of prior decisions by the constitutional review bodies. Considerable attention is paid to the discussion of Russian scientists on the legality of the issue on legislative stipulation for the right of the Constitutional Court of the Russian Federation to revise its decisions. Based on the study the conclusion is made on the need to maintain the grounds in the legislation of the Republic of Belarus for revision of the decisions of the Constitutional Court provided in the Law “On the Constitutional Court of the Republic of Belarus”.

Seidov A.J. Constitutional stage of the implementation of international treaties of the Republic of Azerbaijan
Based on the norms of the Constitution of the Republic of Azerbaijan the author considers the place of international treaties of that country in the system of normative legal acts as a part of the national legal system. It is noted that in the hierarchy of normative legal acts the interstate and intergovernmental treaties of the Republic of Azerbaijan have lower legal force than the Constitution and laws. Accordingly the Constitutional Court of Azerbaijan is entitled to review the constitutionality of such treaties. With regard to international rules on human rights and freedoms, based on international practice of the observance of universally recognised principles of international law the author grounds the conclusion on the legislator’s duty to bring the domestic law in conformity with international one.
