The Chairman of the Constitutional Court of the Republic of Belarus Petr P. Miklashevich took part in XII International Forum on Constitutional Justice on “Property Rights and Free Enterprise: Constitution in Practice”, which was held on 20-21 November 2009 in St. Petersburg at the Constitutional Court of the Russian Federation.
The forum continued the annual meetings of the constitutional courts judges and experts in constitutional law under the aegis of the Constitutional Court of the Russian Federation. All of them were intended to develop the theory and practice of modern constitutional law, to study and generalise topical development issues of constitutional control.
The discussions were held on the issues of constitutional guarantees provision for property rights and free enterprise, constitutional justice influence on the state economic policy, achievement of the best balance of interests, both private and public, in law economy.
At the plenary session the Chairman of the Constitutional Court of the Republic of Belarus Petr P. Miklashevich made a report, in which he emphasised that the Constitution of the Republic of Belarus serves as a basis for property and enterprise relationship as well as for relationship between business and the state. It was also underlined that the Republic of Belarus was proclaimed a social state what turns to be the most important component of the main constitutional goal – a democratic, social state based on the rule of law. It was noted thereat that the Constitutional Court decisions assist to form constitutional economy which provide conditions for property rights and free enterprise as well as for the balance of private initiative and public regulation.
There were held working meetings of the Chairman of the Constitutional Court of the Republic of Belarus Petr P. Miklashevich with chairmen of the constitutional courts of Algeria, Bulgaria, Russia, judges of the European Court of Human Rights. The participants discussed the future development of bilateral co-operation, dramatised the importance of the contacts between the judges of constitutional control bodies for deeper mutual understanding and enrichment by national experience and practice of supranational judicial bodies.
